Event Services Agreement

Standard terms and conditions for all Nectar Candy Co. event bookings.

Services

Base Cart Fee — Up to 3 Hours

  • Nectar Candy Cart on-site for the contracted duration
  • 16 varieties of Swedish candy in dispensers
  • Setup 30 minutes before event start and breakdown after
  • Serving supplies, signage, and branded display
  • On-site candy concierge for full event duration

Per Guest

  • Mix-your-own candy bag for every guest (4oz)
  • Candy concierge–guided tastings throughout the event
  • Flavor profiles and Swedish candy education

Payment Terms

A deposit of 50% of the total event price holds your date. After we receive your deposit, we’ll coordinate directly with your venue to confirm the cart can be accommodated — surface, load-in path, setup space, and any vendor requirements. You don’t need to do anything; we’ll only reach out if there’s a question you need to answer. Your date is fully confirmed once venue suitability is verified. If the venue cannot accommodate the cart and no alternative setup can be arranged, your deposit will be fully refunded.

Payment of the deposit constitutes acceptance of this Agreement.

The remaining 50% balance is due no later than 30 days before the event date. If the event is booked within 30 days of the event date, the balance is due within 14 days of booking.

All major credit and debit cards are accepted via Square.

Guest Count & Final Headcount

The deposit is based on the estimated guest count provided at the time of booking. You'll provide a final guest count no later than 7 days before the event. The balance invoice will be adjusted to reflect the final count.

The final count becomes the billing minimum — if actual attendance is lower, the final count still applies.

If actual attendance exceeds the final count by more than 5%, Nectar will invoice for the additional guests at $8/person within 7 days following the event.

Nectar prepares favor bags based on the final guest count and cannot produce additional bags on-site.

Cancellation & Rescheduling

Rescheduling

With 45+ days notice: reschedule at no charge, subject to Nectar's availability.

With 45 days or less notice: treated as a cancellation; deposit may be applied to a new date at Nectar's discretion.

After final payment: Once the balance has been paid, no refunds will be issued.

Cancellation by Nectar

In the unlikely event that Nectar must cancel due to vehicle breakdown, medical emergency, or other unforeseen circumstance, you will receive a full refund of all payments made.

Weather Policy

Outdoor Events

If severe weather makes outdoor service unsafe or impractical — including thunderstorms, sustained winds exceeding 30 mph, or an active extreme heat advisory — either party may request to reschedule at no charge.

If a mutually agreeable reschedule date cannot be found, you will receive a full refund of all payments made.

Light rain, cold temperatures, or overcast skies do not constitute grounds for cancellation. Weather cancellations must be communicated at least 4 hours before the scheduled event start time.

Venue & Setup Requirements

Nectar will confirm all venue logistics directly with you and/or your venue coordinator prior to the event date. Our cart requires the following:

Surface

Flat, stable ground — pavement, concrete, hardwood, or packed grass

Load-in Clearance

Minimum 5 ft wide × 6 ft tall opening to access the setup area

Cart Size

5 ft × 10 ft

Minimum Footprint

16 ft × 16 ft of clear space for cart, display, and guest flow

Access

No stairs or steep inclines along the load-in path

If the venue cannot accommodate these requirements and no alternative can be found, Nectar will work with you to reschedule or issue a full refund.

Allergen Notice & Liability

Swedish candy products served by Nectar are imported from European manufacturers and may contain or have come into contact with common allergens. The products are manufactured in facilities that handle a variety of ingredients, and cross-contamination cannot be ruled out. Please read this section carefully and share it with guests who have dietary restrictions or food allergies.

Used in several belt and twist varieties

Dietary Notes

Vegan: Most gummy and foam candies contain gelatin and are not vegan. Forest Gummies and Blueberry Rocks are gelatin-free. Check individual listings for details.

Gluten-Free: Several varieties contain no wheat ingredients, but Nectar cannot guarantee no cross-contamination at the manufacturing level.

Halal / Kosher: Most products contain non-certified gelatin. Nectar does not currently carry certified halal or kosher varieties.

Nut Allergies: Our current lineup does not include peanut or tree nut ingredients, but products may be manufactured in facilities that handle nuts.

Client Acknowledges

1.

Client is responsible for reviewing allergen information and communicating relevant details to their guests prior to the event.

2.

Guests with known food allergies or sensitivities should consult the full ingredient list before consuming any product.

3.

Guests select and consume candy at their own discretion and risk.

4.

Nectar provides allergen information in good faith based on manufacturer data, but cannot guarantee a completely allergen-free environment.

5.

Nectar Candy, LLC, its owners, employees, and agents are not liable for any allergic reactions, adverse health effects, or injury resulting from the consumption of candy products at the event.

Indemnification

Client agrees to indemnify, defend, and hold harmless Nectar Candy, LLC, its members, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of allergic reactions or adverse health effects experienced by guests, injury or property damage at the event venue not caused by Nectar's gross negligence, or Client's breach of any term of this Agreement.

Insurance

Nectar Candy, LLC maintains general liability insurance. A Certificate of Insurance (COI) can be provided upon request.

If your venue requires Nectar to be named as an additional insured, please notify us at least 14 days before the event so the endorsement can be arranged.

Photos & Social Media

Nectar may photograph the candy cart setup, display, and overall event atmosphere for use on social media, the Nectar website, and marketing materials.

Nectar will not photograph individual guests without their separate consent. You may opt out of event photography by notifying Nectar in writing prior to the event.

Force Majeure

Neither party shall be liable for failure to perform under this Agreement due to circumstances beyond their reasonable control, including but not limited to: natural disasters, pandemics, government orders, civil unrest, or other events making performance impossible or illegal. In such cases, all payments will be refunded in full or applied to a rescheduled date.

Entire Agreement

This Agreement constitutes the entire understanding between the parties regarding Nectar's event services. Any modifications must be made in writing and agreed to by both parties. This Agreement is governed by the laws of the Commonwealth of Pennsylvania.

By paying the deposit invoice accompanying this Agreement, you confirm that you have reviewed and agree to all terms and conditions set forth above.
